TEKPLUG LIMITED LIFETIME WARRANTY
Fowltek stands behind the materials and workmanship of the TekPlug. Subject to the terms below, Fowltek warrants that each new TekPlug will be free from defects in materials and workmanship for the lifetime of the original retail purchaser.
Who Is Covered
This Limited Lifetime Warranty applies only to the original retail purchaser of a new TekPlug purchased directly from Fowltek or from an authorized Fowltek retailer.
This warranty is not transferable. Proof of purchase may be required to receive warranty service.
What Is Covered
This warranty covers defects in the materials or workmanship of the TekPlug that occur during normal use for its intended purpose and in accordance with all product instructions and safety warnings.
What Fowltek Will Do
If Fowltek determines that a TekPlug has a defect covered by this warranty, Fowltek will, at its option:

Repair the TekPlug;

Replace it with the same or a reasonably equivalent product; or
-
If repair or replacement is not reasonably available, refund the original purchase price.
Repair, replacement or refund is the purchaser’s exclusive remedy under this warranty.
Replacement products may be new or functionally equivalent. Any repaired or replacement product remains covered for the remainder of the original purchaser’s applicable warranty period.
What Is Not Covered
This warranty does not cover damage, failure or performance issues resulting from:

Normal wear, cosmetic damage, scratches or discoloration

Improper installation, removal, adjustment or maintenance
-
Failure to follow Fowltek’s instructions or safety warnings
-
Misuse, abuse, neglect or unintended use
-
Excessive force or the use of improper tools
-
Modification, alteration or unauthorized repair of the TekPlug
-
Use in an incompatible, damaged or improperly maintained firearm
-
Damage caused by a firearm, ammunition, magazine tube, spring, follower or other firearm component
-
Exposure to improper cleaning chemicals, corrosion, excessive moisture, fire, heat or extreme conditions
-
Accidents, impacts, crushing, loss or theft
-
Commercial rental, resale demonstration or other unusually intensive use
-
Products purchased used or from an unauthorized seller
-
Products for which adequate proof of purchase cannot be provided
-
Incorrect configuration of the TekPlug
-
Failure to comply with applicable ammunition-capacity restrictions, hunting regulations or other laws
Firearm Compatibility and Legal Compliance
The purchaser is responsible for confirming that the TekPlug is compatible with the specific firearm in which it will be used.
Before loading or operating the firearm, the purchaser must confirm that the TekPlug is correctly installed, properly configured and functioning as intended.
Firearm and ammunition configurations vary. Fowltek does not warrant that a particular TekPlug configuration will produce a specific ammunition capacity in every firearm or with every type or length of ammunition.
The purchaser is solely responsible for determining the legally permitted ammunition capacity and complying with all applicable federal, state and local laws and hunting regulations.
Always check current regulations before hunting or using the TekPlug. Laws and regulations may vary by location, species, season and firearm type.
The TekPlug is not a firearm safety device. It is not intended to replace safe firearm-handling practices, the firearm manufacturer’s instructions, a firearm safety mechanism or any legally required firearm lock or storage device.
Firearms and Other Property Are Not Covered
This warranty applies only to the TekPlug itself.
It does not cover any firearm, ammunition, magazine tube, spring, follower, accessory or other property used with or near the TekPlug.
Do not use a TekPlug that appears damaged, improperly fitted or incompatible with the firearm. Stop using the product and contact Fowltek if you suspect a defect or compatibility issue.
How to Submit a Warranty Claim
To begin a warranty claim, contact Fowltek before returning the product:

Please provide the following information:

The firearm manufacturer, model and gauge in which the TekPlug was installed, if relevant

The type and length of ammunition involved, if relevant

Any other information reasonably requested by Fowltek to evaluate the claim
Warranty-Claim Procedure

Stop using the product. If you believe the TekPlug is damaged, defective or improperly fitted, unload the firearm completely and stop using the TekPlug.

Provide the requested information. Include proof of purchase, a description of the problem and any requested photographs or video.

Wait for return instructions. Fowltek may be able to resolve the issue without requiring a return. If an inspection is necessary, Fowltek will provide return instructions and, when applicable, a warranty claim or return-authorization number.

Return only the TekPlug. Remove the TekPlug from the firearm and package it securely. Include the claim number and any information requested by Fowltek.

Fowltek will inspect the product. Fowltek will determine whether the condition is covered by this Limited Lifetime Warranty.

Fowltek will provide a remedy. If the claim is approved, Fowltek will repair or replace the TekPlug or, if appropriate, refund the original purchase price.
Important Shipping Instructions
Do not send Fowltek a firearm, ammunition, magazine tube, spring, follower or any other firearm component unless Fowltek specifically requests that non-regulated component in writing.
Fowltek does not accept firearms or ammunition and is not responsible for firearms, ammunition or other unauthorized items included in a shipment.
Do not return a TekPlug without first contacting Fowltek and receiving return instructions.
The purchaser is responsible for properly packaging the TekPlug and following all provided shipping instructions. Unless prohibited by law or otherwise authorized by Fowltek, the purchaser is responsible for the initial cost of sending the TekPlug to Fowltek. If the claim is approved, Fowltek will cover the cost of returning the repaired or replacement TekPlug to the purchaser within the United States.
Shipping costs, inspection charges and other expenses associated with claims that are not covered by this warranty may be the purchaser’s responsibility.
Limitation of Implied Warranties
To the maximum extent permitted by law, any implied warranty, including an implied warranty of merchantability or fitness for a particular purpose, is limited to the shortest duration permitted by applicable law.
Some states do not allow limitations on the duration of implied warranties, so this limitation may not apply to you.
Limitation of Liability
To the maximum extent permitted by law, Fowltek will not be liable for indirect, incidental, special, exemplary or consequential damages arising from the purchase, installation, possession or use of the TekPlug.
This limitation includes, without limitation:

Damage to a firearm or other property

Loss of use
-
Lost profits or revenue
-
Hunting-related losses

Replacement-equipment expenses
-
Fines, penalties or legal expenses
-
Personal injury caused by misuse, improper installation, an incompatible firearm, defective ammunition or failure to follow applicable instructions and warnings
-
Claims made by third parties
Except where prohibited by law, Fowltek’s total liability arising from the TekPlug will not exceed the amount originally paid for the product.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so some of these exclusions or limitations may not apply to you.
No Additional Warranties
No Fowltek employee, dealer, retailer, distributor or other person is authorized to modify this warranty or make any additional warranty on behalf of Fowltek unless the modification is contained in a written agreement signed by an authorized Fowltek representative.
Governing Law
This warranty is governed by the laws of the State of Kansas, without regard to its conflict-of-law principles, except where federal law or applicable state consumer-protection law provides otherwise.
To the extent permitted by law, any legal proceeding relating to this warranty shall be brought in a court of competent jurisdiction serving Rawlins County, Kansas.
